District Court Judge Melissa Kennelly, Presiding Judge
A light district court schedule was heard during this week, due to a one-week jury trial in Taos County for which Judge Kennelly was scheduled.
1. The following persons appeared in District Court on Probation Violation First Hearings
Monique Trujillo (DoB 1992) appeared before the Court on a bail/conditions of release hearing following the State’s Motion to Revoke Probation on original convictions for Battery on a Peace Officer (fourth degree felony), Possession of a Controlled Substance (fourth degree felony) and Possession of Drug Paraphernalia (misdemeanor), convictions from 03/15/2018. After advising the defendant of the allegations and the penalties provided by law, her constitutional and statutory rights, the defendant denied the allegations and the Court set a personal recognizance bond with conditions of release, pending resolution of the Motion to Revoke Probation.
Jennifer Rios (DoB 1983) appeared before the Court on a bail/conditions of release hearing following the State’s Motion to Revoke Probation on original convictions for fourth degree Possession of a Controlled Substance, stemming from a conviction on December 5, 2018. After advising the defendant of the allegations and the penalties provided by law, her constitutional and statutory rights, the defendant denied the allegations and the Court set a $ 5,000 bond, with 10% cash, previously deposited to the Court in this case, with conditions of release, pending resolution of the Motion to Revoke Probation.
2. The following person appeared before the court on a Motion to Revoke Probation:
Gary Gene Sanchez (DoB 1995) appeared and admitted to the State’s Motion to Revoke Probation, following his convictions in April, 2016, for the felony crimes of Battery On a Peace Officer, Escape from Custody of a Peace Officer, five counts of Commercial Burglary, and misdemeanor convictions for two counts of Resisting an Officer. The State recommended Defendant serve the remainder of his sentence in the Department of Corrections. After a review of Defendant’s case prior to Judge Kennelly presiding over the matter, she noted that he has underlying substance abuse issues and has not had treatment opportunities through probation. The Court revoked his probation, but reinstated, ordering him to complete substance abuse treatment and domestic violence counseling. The defendant will remain on supervised probation with all previous conditions plus successful completion of either drug court or inpatient treatment, plus 52-weeks of domestic violence counseling.
