Apr. 7 Filadelfio Chavez entered into a plea agreement in which he pleaded no contest to petty misdemeanor assault and battery, and possession of drug paraphernalia. He was sentenced to 364 days of supervised probation and ordered to complete a domestic violence/anger management program and pay $100 to Raton Crimestoppers.

Shaun Kemp’s probation was revoked and he will serve the remainder of his sentence plus absconder time in the Department of Corrections.

Apr. 9 Patrick Cappellucci had an initial appearance on the motion to revoke probation. He is ordered to remain in custody pending the probation violation hearing.

Apr. 12 Felix Patterson had an initial appearance on the motion to revoke probation. He is ordered to remain in custody pending the probation violation hearing.

Richard Alex Mares entered into a plea agreement in which he pleaded guilty to criminal sexual penetration in the second degree of a child age 13 to 18, child solicitation by electronic device, and tampering with evidence. He was sentenced to serve seven years in the Department of Corrections, followed by an indeterminate 5-to-life period of parole and 5-to-20-year period of probation. He will be required to register as a sex offender upon release from prison.

Apr. 19 David Salazar had an initial appearance on the motion to revoke probation. He was released to supervised probation pending the probation violation hearing.

Kyla Marie Guerrero was arraigned on the felony charge of selling, disposing of, or possessing dangerous drugs. She was ordered to comply with standard conditions of release.

Daniel McGrath waived arraignment on felony aggravated battery with a deadly weapon and criminal damage to property under $1000. He was ordered to comply with standard conditions of release.

Michael Sandoval was arraigned on felony shoplifting (over $500) and misdemeanor shoplifting. He was ordered to comply with standard conditions of release including not entering the premises of Tractor Supply, Family Dollar, and Mesa Pharmacy.

Brittany Romero’s probation was revoked and she will serve 373 days in the Department of Corrections with a referral to the prison’s drug treatment program.

Bobby Sisneros’s probation was revoked and he will serve 556 days in the Department of Corrections with a referral to the prison’s drug treatment program.

Jason Adam Duran was arraigned on felony possession of methamphetamine. He was ordered to comply with standard conditions of release including weekly random drug testing.

Jayson Smith had an initial appearance on the motion to revoke probation. He was released to an inpatient treatment program pending the probation violation hearing.

Phillip Michael Ray Apalacio had an initial appearance on the motion to revoke probation. He was ordered to report to supervised probation and to engage in weekly random drug testing pending the probation violation hearing.

Apr. 29 Jerry Gilbert Espinoza was found guilty by a jury of criminal sexual penetration in the first degree of a child age 13 to 18 and incest. He was sentenced to serve 15 years in the Department of Corrections, followed by an indeterminate 5-to-life period of parole and 5-to-life period of probation. He will be required to register as a sex offender upon release from prison.

Matthew Hephner entered into a plea agreement in which he pleaded guilty to felony battery upon a healthcare worker, and misdemeanor assault upon a healthcare worker, aggravated driving while under the influence of liquor or intoxicating drugs, and negligent use of a deadly weapon. He was sentenced to four years of supervised probation, to follow recommendations of a drug and alcohol screening, to pay $100 to Raton Crimestoppers, to complete DWI school, to complete 24 hours of community service, and to have an ignition interlock installed on his vehicle for a period of one year.
