Mark Marshall Arrested Again

Mark Marshall age 33 has become well known to Raton Police and Colfax Sheriff having been arrested again for charges stemming from several Magistrate Bench Warrants for failure to appear in several cases.

Marshall is currently being held at the Vigil Maldonado Detention Center on a no bond hold by District Court as a result of not appearing for  previous court appearances and numerous felony charges that occurred while out on bail. In May of 2018 Marshall was charged with falsely obtaining services or accommodations from Raton Public Service Company. He has been charged with aggravated fleeing from officers for an incident in August after a warrant was issued for failure to appear and also charged with false imprisonment of a female party.

In August Raton Police were dispatched to the parking lot at 129 Clayton Road for a domestic fight taking place. As officer Hightree arrived a white car was pointed out to him. Hightree attempted to stop the vehicle and the passenger door opened and a male exited the vehicle. Hightree gave chase across Clayton Road with Marshall almost causing an accident with oncoming traffic. Officer Hightree again requested Marshall stop running. Marshall continued to flee and officer Hightree tazed Marshall bringing him to a stop in the middle of Clayton Road. Officer Valdez had joined the fray at that time and Marshall was placed in custody. He was transported to MCMC for tazer probe removal and then transported to VMDC.

According to the Arrest Warrant issued for Marshall in November, Marshall was observed heading east on Highway 72 when officer John Rodarte attempted to stop Marshall. The vehicle then proceeded to speed away. Rodarte gave up the chase requesting help from Colfax County Sheriff’s office. The vehicle was later spotted with the defendant’s girlfriend driving the vehicle. It was reported Marshall had fled on foot in the Yankee area. Officers were unable to locate the individual. He was later arrested without incident and transported to VMDC

On November 30 Marshall again faced police and K-9 unit Carlo after a traffic stop where Marshall again tried to flee from police. Marshall fought with Carlo and officer Coca attempted to taze Marshall but only one probe made contact. Marshall was finally arrested with help from other officers and transported to MCMC for medical treatment.

Because of the repeated run ins and now felony charges being filed against Marshall in District court Marshall’s girlfriend Erika Montoya was later arrested at her residence and charged with aiding, harboring a felon and refusing and resisting an officer.

The burglary charges and possession of a firearm by a felon stem from a burglary at the Van Sweden Ranch south of Raton in October of 2018. Marshall had later sold many of the items to residents in Raton which were later reported to Colfax Deputies.

To date and just in the last year Mark Marshall has been charged with Falsely Obtaining Services ($250 or Less); Resisting, Evading or Obstructing an Officer (Arrest); Use or Possession of Drug Paraphernalia; Aggravated Fleeing a Law Enforcement Officer; False Imprisonment; Aggravated Burglary (Armed after Entering); Receiving Stolen Property – Dispose (Over $2,500 but not more than $20,000); Tampering with Evidence (Highest Crime a Capital, First or Second Degree Felony); Breaking and Entering; Criminal Damage to Property (Over $1000); Possession of a Firearm or Destructive Device by a Felon; Disarming a Peace Officer (Depriving of the Use of a Firearm or Weapon); Possession of a Controlled Substance (Felony – Narcotic Drug) x2; Resisting, Evading or Obstructing an Officer (Arrest); Injury to a Police Dog, Police Horse or Fire Dog (No Serious Physical Injury or Death). Marshall’s criminal history goes back to 2007 when he was charged with misdemeanor disorderly conduct.
