Union County– On April 8, 2015, New Mexico State Police was called to investigate allegations of criminal misconduct by a Clayton Police Officer.
As a result of the investigation, Clayton Montoya, twenty three years of age, was arrested on April 9, 2015 and booked into the Union County Jail on the following charges.
False Imprisonment (Fourth Degree Felony)
Aggravated Assault (Fourth Degree Felony)
Battery (Petty Misdemeanor)
No other details are available at this time. The case is still under investigation.

According to court records filed last week Montoya is accused of pointing a Taser at a 17-year-old girl and forcing her to sit in his lap.
The documents went on to say the girl was temporarily left alone with with Montoya while she was working at her family owned cafe in Clayton on April 8. After taking his order, the girl said Montoya followed her to the counter and began talking to her. She knew the officer as he was a cousin of her best friend.
During the conversation, The affidavit indicates that Montoya unholstered hs stun gun, activated it and pointe the laser light to the midsection of her body. She told State Police she felt the officer’s stun gun other hip and was scared. When she attempted to get up, Montoya grabbed her and forced her to sit back down on his lap, according to the arrest affidavit.
When the girl’s mother reentered the cafe and saw her daughter sitting on Montoya’s lap, she said the girl immediately stood up and looked like she was waiting for the opportunity to get up. The mother told Montoya to leave and he did.
According to the affidavit Montoya later allegedly sent a message to the girl on social media app “snapchat” stating, “Don’t say anything please, I’m going to lose my job you are only 18.”
State Police arrested monty on April 9 after they were notified of the allegations of criminal misconduct by the officer from the day before.
IT SEEMS TO ME THAT CLAYTON HAS BEEN TRIED AND COVICTED ALREADY, THEY ARE NOW GETTING THE ROPE. I KNOW CLAYTON AND HE WOULD NEVER EVER NEVER DO WHAT HE IS ACUSED OF. I THINK (AS DO OTHERS) THAT HE WAS FRAMED BECAUSE CERTAIN PEOPLE DIDNT LIKE HIM.
