Suspect Faces Federal Charges of Aggravated Battery Against Mail Carrier (Updated)

ALBUQUERQUE – Cody Martinez, of Raton who was arrested originally on Jan. 20, 2016,  on local charges of aggravated battery with a deadly weapon, tampering with evidence, criminal trespass and disorderly conduct, had local charges dismissed in favor of federal prosecution and made his initial appearance Tuesday, Feb. 2nd  in federal court in Albuquerque, N.M. The criminal complaint charging him with assaulting a federal employee.  He remains in federal custody pending a preliminary hearing and a detention hearing, both of which are scheduled for Wednesday morning, Feb. 3rd.

According to the criminal complaint, Martinez allegedly struck the victim in the back of the head with a brick while the victim was delivering mail in Raton,  Colfax County, N.M., on Jan. 20, 2016.  Martinez was apprehended shortly thereafter as he allegedly attempted to flee from law enforcement officers.  The victim sustained serious injuries as a result of the assault.

If convicted on the federal assault charge, Martinez faces a statutory maximum penalty of ten years in federal prison.

This case was investigated by the U.S. Postal Inspection Service and the Raton Police Department, with assistance from the 8th Judicial District Attorney’s Office.  Assistant U.S. Attorney Presiliano Torrez is prosecuting the case.

Special to KRTN 1/21/16 – On January 20, 2016 at approximately 10:12 am, Raton Police Department officers were dispatched to the 600 block of North 2nd Street in reference to a male subject beating a mailman with a brick. When officers arrived on scene, the male victim identified as David Boyer (62) of Trinidad was located unconscious and face down, bleeding from the head. Raton EMS was summoned to the scene to treat Boyer’s wounds and transported him to Miners Colfax Medical Center. Police Chief John Garcia told KRTN that Boyer has since been transported to Pueblo, Colorado with several serious injuries.

Officers located the suspect not far from the scene on the 100 block of Maxwell Avenue still carrying the brick used to assault Boyer. Suspect, Cody A. Martinez (29) of Raton, was taken into custody without incident and transported to Vigil Maldonado Detention Center where he is charged with aggravated battery with a deadly weapon, tampering with evidence, criminal trespass and disorderly conduct.

The U.S. Postal Inspection Service out of Albuquerque has been contacted, and Martinez will also be facing charges on a federal level.
