Colfax County Sheriff’s Deputy and State Police were called to a residence on Hwy 445 in Maxwell just after 3:00 a.m. Sunday morning to investigate a report of shots fired.

Upon arrival at the scene the deputy found that three shots had been fired into a mobile home owned by Fred Martinez. According to the report filed by Deputy James Atkins the shots had been fired into the north wall of the home. One shot came through the wall and struck the bathtub in the master bathroom. The second one came through the bathroom and lodged in a walk-in closet near the bathroom and lodged in some clothing hanging in the closet. The third shot came through the bedroom wall and lodged in the headboard of the bed that the occupants of the home were sleeping in.

All three bullets were found in the house and are believed to be 222 or 223 caliber bullets. According to the report it is believed the shots came from the direction of the Maxwell Village water towers. A search of the area around the tanks was conducted later in the morning once daylight broke but no evidence was found at that time.

A canvass of the neighborhood indicates that no one heard the shots but a loud vehicle was noted by one resident in the area about that same time. As of this time there are no suspects in the case and the sheriff’s office would like your help in solving this case that could have easily turned deadly. If you have any information please call 575-445-5561.
